PoolControlHQ provides a subscription-based software platform that allows users to manage and monitor pool and spa systems, including integrations with third-party vendors such as pool control system providers.

The Service is provided for informational and management purposes only and does not replace professional pool maintenance or safety oversight.

3. Eligibility and Accounts

Account Registration

To use the Service, you must create an account using a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Account Security

  • Accounts are protected by password authentication and may include two-factor authentication (2FA).
  • You agree to notify us immediately of any unauthorized use of your account.

4. Subscriptions, Free Trials, and Billing

Free Trial

PoolControlHQ may offer a free trial period. At the end of the trial, your account may require a paid subscription to continue using certain features.

Paid Subscriptions

  • Subscriptions are billed on a monthly basis unless otherwise stated.
  • All payments are processed through a third-party payment processor.
  • PoolControlHQ does not store your credit card information.

Changes and Cancellation

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of the current billing period unless otherwise specified.

5. Use of Third-Party Services

The Service may integrate with third-party systems (such as pool equipment providers) using credentials you supply.

  • You authorize PoolControlHQ to access these third-party services on your behalf solely to provide the Service.
  • PoolControlHQ is not responsible for outages, errors, or changes in third-party services.
  • Your use of third-party services is governed by their own terms and policies.

6. User Responsibilities

You agree not to:

  • Use the Service for unlawful or unauthorized purposes
  • Attempt to gain unauthorized access to systems or data
  • Interfere with or disrupt the Service or servers
  • Misuse guest access features or provide access to unauthorized parties
  • Reverse engineer or attempt to extract source code from the Service

You are solely responsible for ensuring that use of the Service complies with applicable laws and safety requirements.

7. Guest Access

Account owners may invite guests to access limited portions of the Service.

  • You are responsible for managing guest access and permissions.
  • PoolControlHQ is not responsible for actions taken by guests you authorize.

8. Data and Activity Logging

To operate and improve the Service, PoolControlHQ logs system and user activity (such as actions performed within the platform).

These logs are used for security, troubleshooting, auditing, and product improvement purposes.

9. Account Termination

By You

You may delete your account at any time through the Service. Upon deletion, access to the Service will be terminated.

By Us

We may suspend or terminate access to the Service if you violate these Terms or misuse the platform, with or without notice where permitted by law.

10. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis.

PoolControlHQ makes no warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee uninterrupted or error-free operation of the Service.

11. Limitation of Liability

To the maximum extent permitted by law, PoolControlHQ Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of revenue, or loss of use of the Service.

Our total liability for any claim related to the Service shall not exceed the amount paid by you to PoolControlHQ in the two (2) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless PoolControlHQ Inc. and its officers, directors, employees, and affiliates from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

13. Changes to the Service and Terms

We may modify the Service or these Terms from time to time. Changes will be effective when posted on the website.

Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles.
